These Terms of Service ("Terms") govern your access to and use of QuenDraft AI ("we", "us", or "our"), including our website, web application, and browser extension (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Acceptance of terms
By accessing or using QuenDraft AI, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy. These Terms form a binding agreement between you and QuenDraft AI.
If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Eligibility
You must be at least 13 years old to use QuenDraft AI. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. We do not knowingly provide the Service to children under 13.
3. Accounts and registration
Creating an account
To access most features, you must register for an account using a valid email address or a supported OAuth provider (Google, Microsoft). You agree to provide accurate and complete information.
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@quendraft.com if you suspect unauthorised access.
Account deletion
You may delete your account at any time from Account Settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.
4. Permitted use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business purposes. You may:
- Use the web application and browser extension to assist with writing, grammar, paraphrasing, and AI tasks.
- Install the browser extension on supported browsers (Chrome, Edge, Brave, Opera) for personal use.
- Access AI-generated content produced by the Service for your own use.
5. Prohibited use
You agree not to:
- Use the Service to generate content that is illegal, defamatory, harassing, or infringes third-party rights.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use automated scripts, bots, or scrapers to access the Service without our written permission.
- Resell, sublicence, or redistribute the Service or any content generated through it on a commercial basis without our consent.
- Circumvent any usage limits, rate limits, or access controls.
- Use the Service to generate spam or unsolicited mass communications.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Introduce malware, viruses, or other harmful code.
We reserve the right to suspend or terminate your account if you violate these restrictions.
6. AI-generated content
Accuracy
AI-generated content may be inaccurate, incomplete, or out of date. You are solely responsible for reviewing and verifying any content produced by the Service before relying on it or sharing it.
Ownership
To the extent permitted by law, you retain ownership of the input you provide and the output the Service generates for you. We do not claim ownership of your content.
Training
Your content is not used to train our AI models or the underlying models of our third-party AI providers. See our Privacy Policy for details.
7. Intellectual property
The Service, including its design, software, trademarks, and brand assets, is owned by QuenDraft AI and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property other than the limited licence described above.
You retain all rights to content you create. By using the Service, you grant us a limited licence to process your content solely to provide the Service to you.
8. Subscriptions and billing
Free plan
QuenDraft AI offers a free tier with limited usage. No credit card is required to sign up.
Paid plans
Paid plans are billed monthly or annually depending on your selection. All fees are charged in advance and are non-refundable except as described in our refund policy.
Refunds
We offer a 7-day money-back guarantee for new paid subscriptions. To request a refund, contact support@quendraft.com within 7 days of your initial purchase.
Cancellation
You may cancel your subscription at any time from Account Settings. You will retain access to paid features until the end of the current billing period.
Price changes
We may change subscription pricing with at least 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may terminate your account at any time through Account Settings.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or complete.
11. Limitation of liability
To the maximum extent permitted by law, QuenDraft AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $10, whichever is greater.
12. Governing law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as mutually agreed.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, notify you via email or an in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
